"Komposer" refers to the Website and related services operated by Komposer, LLC. By accessing or using Komposer, whether through free or paid versions, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Website.

The multimedia content available on Komposer, including games, activities, videos, and printables, is intended for online use only. Komposer, LLC reserves the right to modify, withdraw, suspend, or discontinue in whole or in part (temporarily or permanently, at any time and from time to time, and with or without notice) any materials, information, or content available on the Komposer website, including, without limitation, the cessation of all activities associated with the Komposer website. You agree that, except as may be required by law, Komposer, LLC will not be liable to you or to any third party for any modification, suspension or discontinuance of the Komposer website or any part thereof.

Komposer is primarily supported by advertising revenue. Our advertising partner is Ad Metrics Pro, providing COPPA-compliant advertising suitable for educational environments. Advertisements enable us to provide Komposer free of charge. Ad revenue supports our software developers, website designers, game licensing, website hosting, bandwidth, image and sound files, productivity software, privacy certification, and essential computer equipment. We respectfully request that you disable any ad-blocking software while using Komposer to help ensure the continued availability of these resources. Your support through allowing advertisements enables us to create new educational content and license high-quality games. Thank you for your understanding.

You are prohibited from taking screenshots or capturing video of any part of Komposer without explicit written permission from Komposer, LLC.

Komposer grants you a revocable permission to link to our Website, provided that the following conditions are met:

• The link must not frame or create a browser or border environment around any of the Komposer content, nor mirror any portion of the Website.
• The link must not imply that Komposer endorses or sponsors any third party, their products, or services, unless express written consent has been granted.

Komposer reserves the right, but does not assume the responsibility, to monitor or review your conduct on Komposer. Your use of Komposer is subject to all applicable local, state, national and international laws and regulations.

In using Komposer you agree not to post, transmit, or otherwise make available, through or in connection with Komposer:

• Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, "scrape," "data mine" or in any way gather Content or Materials from Komposer or reproduce or circumvent the navigational structure or presentation of Komposer.
• Engage in any other conduct which, in Komposer’s sole discretion, is considered inappropriate, unauthorized or objectionable.

You warrant to Komposer, LLC that you will not use the Website for any purpose that is unlawful or prohibited by these Terms. You may not use Komposer in any manner that could damage, disable, overburden, or impair the Website or interfere with another user's enjoyment of it. You may not attempt to obtain any materials or information through any means not intentionally made available through Komposer.

Any materials (including but not limited to feedback, suggestions, ideas, or creative content) submitted to Komposer via email, postal mail, or website submission forms become the exclusive property of Komposer, LLC. By using Komposer, you agree to submit to the personal and exclusive jurisdiction of the courts of Middlesex County, Massachusetts.

In the event that Komposer, LLC is acquired by or merged with another entity, you understand and agree that we may assign our rights under these Terms and that your personal information may be transferred to the succeeding entity.

Komposer AND ALL RELATED SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Komposer, LLC DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IN NO EVENT SHALL Komposer, LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF Komposer, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH Komposer IS TO DISCONTINUE YOUR USE OF THE WEBSITE.

Komposer, LLC reserves the right, in its sole discretion, to terminate your access to the Website and related services at any time, without notice. This Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any action at law or in equity arising out of or relating to these Terms shall be filed only in the state or federal courts located in Suffolk County, Boston, Massachusetts. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Komposer, LLC as a result of this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between you and Komposer, LLC with respect to the Website and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

All content on Komposer is copyrighted by Komposer, LLC and/or its suppliers. All rights reserved. The names of actual companies and products mentioned may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved.

Komposer, LLC reserves the right to modify these Terms of Service at any time. The effective date of any changes will be posted at the top of this Agreement. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms of Service.
